Welcome to fennells.com (the "Site"), operated by Fennell’s ("Fennell’s," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Site, including browsing, creating an account, and purchasing products, whether as a guest or registered user.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Fennell’s is a family-owned maker and retailer of handmade leather goods, horse tack and equipment, dog accessories, stable supplies, and related products, operating since 1909.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or place an order on the Site. By using the Site, you represent that you meet this requirement.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at info@fennells.com if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

We make every effort to accurately describe and display our products, including handmade leather goods, tack, and custom items. However:

• Because many of our products are handmade, slight variations in color, texture, size, and finish should be expected and are not defects.
• Colors and details may also appear slightly different due to your device’s display settings.
• Product availability is not guaranteed until your order is confirmed, and items may sell out or be discontinued without notice.
• We reserve the right to correct pricing, typographical, or other errors on the Site at any time, including after an order has been submitted, and to cancel any order affected by such an error, in which case we will notify you and issue a full refund for that order.

All prices are listed in U.S. dollars and do not include applicable sales tax or shipping charges, which will be calculated and displayed at checkout.

We accept custom and large orders for certain products. Custom orders are made to your specifications and may require a deposit, longer lead times, and are generally non-cancelable and non-returnable once production has begun, except as required by law or as otherwise agreed with you in writing at the time of order.

By placing an order, you are making an offer to purchase the selected products subject to these Terms. We reserve the right to accept or decline any order for any reason, including suspected fraud, errors in pricing or product information, or unavailability of stock.

Payment is processed at the time of order through our third-party payment processor(s). You represent that you are authorized to use the payment method provided and that the information you supply is accurate and complete. We do not store your full payment card information on our servers.

We will make reasonable efforts to ship orders within the timeframe stated on the Site, but shipping and delivery dates are estimates only and are not guaranteed. Risk of loss and title to products pass to you upon our delivery to the carrier. Shipping costs, available methods, and any applicable restrictions will be presented at checkout.

Unless otherwise stated at the time of purchase, custom, personalized, and made-to-order items, gift certificates, and clearance or final-sale items are not eligible for return or refund.

Gift certificates sold through the Site or in-store are not redeemable for cash except where required by law, are non-refundable, and may be subject to additional terms provided at the time of purchase.

All content on the Site — including text, graphics, logos, product photography, and design — is owned by or licensed to Fennell’s and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and download content from the Site for your own personal, non-commercial use only. You may not reproduce, distribute, modify, or otherwise use any Site content for commercial purposes without our prior written consent.

When using the Site, you agree not to:

• Violate any applicable law or regulation
• Use the Site for any fraudulent or unauthorized purpose
• Attempt to gain unauthorized access to the Site, other accounts, or our systems

TO THE FULLEST EXTENT PERMITTED BY LAW, FENNELL’S AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Fayette County, Kentucky, and you consent to personal jurisdiction and venue there.

We may revise these Terms at any time by updating this page with a new "Effective Date." Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
